PLEASE READ CAREFULLY BEFORE PARTICIPATING
This Release of Liability and Assumption of Risk Agreement ("Agreement") is entered into by the undersigned participant ("Participant") in favor of OtterSpace Wildlife, including its directors, officers, employees, volunteers, contractors, partners, landowners, and affiliates (collectively, "the Sanctuary").
By purchasing a ticket, registering for, or participating in any guided tour, program, or activity offered by the Sanctuary, the Participant acknowledges and agrees to the following terms.
1. Assumption of Risk
Participant understands and acknowledges that activities at a wildlife sanctuary involve inherent risks, including but not limited to:

Uneven or unpaved terrain, trails, boardwalks, steps, roots, rocks, mud, sand, and water crossings
-
Exposure to wild and semi-wild animals, insects, reptiles, birds, and other wildlife
-
Bites, stings, scratches, or other contact with animals or insects
-
Weather conditions including heat, cold, humidity, rain, storms, wind, and sun exposure
-
Slips, trips, falls, and physical exertion
-
Remote locations with limited or delayed access to medical care
Participant voluntarily assumes all known and unknown risks, whether foreseeable or unforeseeable, associated with participation in Sanctuary activities.
2. Release and Waiver of Liability
In consideration of being permitted to participate in Sanctuary activities, Participant hereby releases, waives, discharges, and holds harmless the Sanctuary from any and all claims, demands, actions, causes of action, damages, losses, costs, or expenses arising out of or related to participation, including but not limited to:

Personal injury or death
-
Illness or disease
-
Property damage or loss
This release applies to the fullest extent permitted by law, including claims arising from the ordinary negligence of the Sanctuary.
3. Medical Responsibility
Participant certifies that they are physically and mentally capable of participating in Sanctuary activities and has no medical condition that would prevent safe participation. Participant understands that the Sanctuary does not provide medical care and agrees to assume responsibility for any medical expenses incurred as a result of participation.
In the event of an emergency, Participant authorizes the Sanctuary to seek emergency medical treatment on their behalf if necessary.
4. Rules, Safety, and Conduct
Participant agrees to:

Follow all instructions provided by Sanctuary staff and guides

Remain on designated trails and areas
-
Refrain from touching or feeding wildlife unless explicitly permitted
-
Behave in a safe and respectful manner toward wildlife, staff, other participants, and the environment
Failure to comply may result in removal from the activity without refund.
5. Photography and Media Release
Participant grants permission to the Sanctuary to use photographs, video, or audio recordings taken during activities for educational, promotional, or informational purposes, without compensation, unless otherwise stated in writing.
6. Minors
If Participant is signing on behalf of a minor, Participant represents that they are the parent or legal guardian of the minor and agrees to this Agreement on behalf of the minor. Participant further agrees to release and indemnify the Sanctuary from any claims brought by or on behalf of the minor.
7. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Florida, without regard to conflict of law principles.
8. Acknowledgement and Agreement
By purchasing a ticket, checking the required acknowledgment box during registration, or participating in Sanctuary activities, Participant confirms that:

They have read and understand this Agreement

They voluntarily accept all risks

They agree to be bound by the terms of this Release of Liability and Assumption of Risk
If Participant does not agree to these terms, they should not participate in Sanctuary activities.
